Buying Properties from Re-Sellers

If the ownership title was not transferred yet to the re-seller (current owner), the buyer have to check whether the property was already fully paid, if not at least partially paid, by re-seller from the original owner. This is very important because the buyer will be needing the original owner to sign Deed of Sale, or any form of deed of conveyance, in order for the title to be transferred to his / her name.


Re-Sellers just partially paid the property which is still under the name of the original owner

  • The buyer will still be needing the original owner (husband and wife for conjugal properties, while the surviving spouse and his/her children should the owner already passed away) to sign Deed of Sale or any form of deed of conveyance (or Contract to Sell in case of installment sales).
  • Check if there is an Acknowledgement Receipt for the full payment of the purchase price and confirm with original owner if the purchase price was paid in full.

  • The original owner have to be informed by the buyer of his / her interest to buy the property and that he / she needs the owner to sign Deed of Sale, or any deed of conveyance. If the buyer can sense out that there will be no problem with the original owner, then it is good to go.
  • Even if it is fully paid, if the original owner is hesitant of signing Deed of Sale, or any form of deed of conveyance, for whatever reason, the buyer have to think very carefully whether to proceed with the transaction. This is because the title cannot be transferred to the buyer directly without the signature of the original owner. An option however is to have the title transferred from the original owner to the re-seller (current owner) and then after 6 months of titling, the re-seller can execute Deed of Sale to transfer the title to the buyer. But this will be a very lengthy process.
